Terms and Conditions

These Terms of Use and Conditions are made and entered into by and between you and Lisa Calvocoressi, Ph.D., Anthony Pinto, Ph.D., Barbara Van Noppen, Ph.D., Monica S. Wu, M.A., Carolyn M. Mazure, Ph.D., and Lawrence H. Price, M.D. (hereinafter referred to as “Developers”). By using this site, including accessing and downloading materials or content provided therein, you acknowledge that you have read these Terms of Use and Conditions, disclaimers, and policies and that you accept and will be bound by their terms. A full and comprehensive recitation of the Terms of Use and Conditions, disclaimers, and policies may be found below.
1.1 Summary. In summary, by using this site including accessing and downloading Copyrighted materials or content provided therein, you accept and will be bound as follows:
- You accept and will be bound, in the course of using downloadable content or materials, to guard against the unauthorized use, reproduction, modification, distribution, or transmission in any form or by any means including photocopying, recording, or other electronic or mechanical methods of all downloadable content or materials within the User’s control or possession by any third party.
- You accept and will be bound to use all downloadable content or materials for its intended purpose as set forth therein WITHOUT ANY REVISIONS, CHANGES, OR MODIFICATIONS WHATSOEVER WITHOUT THE PRIOR WRITTEN PERMISSION of the Permissions Coordinator identified above.
- You accept and will be bound TO SEEK PRIOR WRITTEN PERMISSION OF THE PERMISSIONS COORDINATOR TO REVISE, CHANGE, MODIFY, USE, OR ADAPT DOWNLOADABLE CONTENT OR MATERIALS for clinical or research purposes, or for all other purposes other than its intended purpose as set forth in the general information, instructions, and/or overview section(s) of the downloadable content or materials.
- You accept and will be bound to reimburse and make whole from all loss and/or damages resulting from the unauthorized use, reproduction, modification, distribution, or transmission in any form or by any means including photocopying, recording, or other electronic or mechanical methods of downloadable content or materials within the User’s control or possession by any third party, provided User is determined to have been careless and/or negligent in his/her use of Copyrighted content or materials, or is in breach of the Terms of Use and Conditions.
2.1 Acceptance of Terms of Use and Conditions. Developers provide its online services, resources, and Web Site to you, the User, subject to these Terms of Use and Conditions (“TOUC”). Developers reserve the right to alter the TOUC at any time without notice to User. By using this web site, located at the URL, https://publichealth.yale.edu/familyaccommodationocd/, User agrees to abide by this TOUC Agreement.
2.2 Online Services and Disclaimer of Warranty. This web site provides online resources including, but not limited to, online information regarding the Family Accommodation Scale, an instrument used worldwide in research and clinical practice to assess the behaviors of family members of patients with obsessive compulsive disorder, as well as downloadable interviewer-rated, self-rated, and patient-rated versions of said instrument, which are available in multiple languages. Any new services, resources, informational content or materials, or downloadable content or materials added to the web site shall fall under the terms of this TOUC Agreement. The online resources, informational and downloadable content or materials on this web site is provided “AS IS”, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABILITY OF ANY DOWNLOADABLE CONTENT OR MATERIALS, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATIONAL CONTENT OR MATERIALS, OR SYSTEM INTEGRATION, OR NON-INFRINGEMENT. Developers assume no responsibility for any data loss or other loss suffered by any User of this web site. User is fully responsible for maintaining its computer equipment and internet access to use this web site.
2.3 User Conduct. User agrees to:
(a) in the course of using the downloadable content or materials, GUARD against the unauthorized use, reproduction, modification, distribution, or transmission in any form or by any means including photocopying, recording, or other electronic or mechanical methods of all downloadable content or materials within User control or possession by any third party.
(b) USE all downloadable content or materials for its intended purpose as set forth therein WITHOUT ANY REVISIONS, CHANGES, OR MODIFICATIONS WHATSOEVER without the prior written permission of the Permissions Coordinator.
(c) SEEK PRIOR WRITTEN PERMISSION OF THE PERMISSIONS COORDINATOR TO REVISE, CHANGE, MODIFY, USE OR ADAPT DOWNLOADABLE CONTENT OR MATERIALS for clinical research purposes, or for all other purposes other than its intended purpose as set forth in the general information, instructions, and/or overview section(s) of the downloadable content or materials.
(d) REIMBURSE and MAKE WHOLE from all loss and/or damages resulting from the unauthorized use, reproduction, modification, distribution, or transmission in any form or by any means including photocopying, recording, or other electronic or mechanical methods of downloadable content or materials within User control or possession by any third party, provided User is determined to have been careless and/or negligent in his/her use of Copyrighted content or materials, or is in breach of the Terms of Use and Conditions.
(e) NOT reproduce, copy, duplicate, sell, or otherwise distribute downloadable content or materials, or any portion thereof, for a commercial and/or pecuniary purpose.
(f) NOT intentionally or unintentionally violate any local, state, or federal law, including violations of the Copyright Act.
(g) NOT upload, post, transmit any informational content or materials that is the copyrighted, patented or trademarked intellectual property of the Developers or of another, or the trade secret of or confidential information of the Developers or of another.
(h) NOT interfere with the operation of the Developers’ web servers or other computers or internet or network connections.
(i) NOT upload, post or transmit any software or files that contain software viruses or other harmful computer code.
(j) NOT impersonate another User, person, or entity including any official, agent, or employee of the Developers.
(k) NOT collect personal information on, “cyberstalk” or harass another User, or engage in conduct that negatively affects the online experience of another User or the Public.
(l) NOT upload, post, or transmit any informational content or materials that is unlawful, threatens another person or entity, defamatory, vulgar, obscene, libelous, invades the privacy of another, or is otherwise objectionable.
(m) NOT upload, post or transmit and unsolicited or unauthorized advertising, including “spam” or “junk mail.”
2.4 Link Disclaimer Policy. The use of this site is governed by our “Hyperlink Disclaimer,” (§2.5), “Informational Content Disclaimer,” (§2.6), “Privacy Policy,” (§2.7) as well as all other relevant provisions or the TOUC Agreement. By using this site, you acknowledge that you have read these disclaimers and polices and that you accept and will be bound by their terms.
2.5 Hyperlink Disclaimer. The web site may contain hyperlinks to other internet sites not under the editorial control of Lisa Calvocoressi, Ph.D., and/or the Developers. These hyperlinks are not express or implied endorsements or approvals by Lisa Calvocoressi, Ph.D. (and/or Developers) of any content, materials, products, services, or information available from these sites.
2.6 Informational Content Disclaimer. THE INFORMATION AND DOWNLOADABLE CONTENT OR MATERIALS AVAILABLE OR PROVIDED ON THIS WEB SITE IS PROVIDED “AS IS” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABILITY OF ANY COMPUTER PROGRAM OR SOFTWARE, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATIONAL CONTENT OR MATERIALS, OR SYSTEM INEGRATION, OR NON-INFRINGEMENT. DEVELOPERS BEARS NO LIABILITY FOR ANY INACCURATE INFORMATION OR DOWNLOADABLE CONTENT OR MATERIALS AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE INFORMATION OR DOWNLOADABLE CONTENT OR MATERIALS RECEIVED, WHICH IN THIS CASE, IS ZERO ($0.0) US DOLLARS. THE DEVELOPERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, LOSS OF BUSINESS, LOSS OF PROFITS, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE.
2.7. Privacy Policy.
2.7.1 Developer Privacy Policy covers Developers’ treatment of personal or personally identifiable information (“Personal Information”) that may by collected when you are on the web site and when you use Developers’ services, if any. This policy does not apply to the practices of companies that Developers does not own or control, or to individuals who are not under Developers’ supervision or control.
2.7.2 Developers may collect Personal Information when you use certain services including accessing downloadable content or materials on the web site or when you visit cookie-enabled web pages. Developers may also log your IP address when you use the web site. Developers use this Personal Information to fulfill requests for our services including informational and downloadable content or materials, to contact Users regarding changes to our site or our practices, and to customize the materials that you might see on the web site. Developers may also use “Cookie” files to better serve your needs by creating a customized web site which fits your needs, if applicable.
2.7.3 Developers will not sell or rent your Personal Information to any individual, business, or government entity. Developers will share your Personal Information with other entities should you request Developers to share such information, or if Developers is required to respond to court orders, subpoenas or other legal process.
2.7.4 Developers may allow Users to set up personal accounts in order to access downloadable content or materials or to participate in our online communities, such as our message boards, where applicable. In the event Users are permitted to set up personal accounts, you have the ability to edit your User Information at any time and may delete your account at your convenience. Under no condition will Developers share your user account information with another individual, business or government entity, unless Developers is required to respond to court orders, subpoenas or other legal process.
2.7.5 In the event user accounts are permitted, all user account pages are protected with Secure Socket Layer (“SSL”) encryption, or with an equivalent encryption system. All user accounts must be accessed with usernames and passwords. You are advised not to share your username and password with any other person.
2.7.6 Developers reserves the right to amend this policy at any time without prior notice. Developers will post a notice of changes on its web site, when and if the terms of this policy are amended.
2.7.7 Users may contact Developers directly by emailing at lisa.calvocoressi@yale.edu should you have questions regarding this policy.
3.1 Registration. Certain areas of the Developers’ web site may be provided solely to registered Users of the web site including access to downloadable content or materials. Any User registering for such services agrees to provide true and accurate information during the registration process. Developers reserves the right to terminate the access of such Users should Developers know, or have reasonable grounds to suspect, that a User has entered false or misleading information during the registration process. ALL REGISTERED USERS MUST BE OF LEGAL AGE TO REGISTER. Children under the age of 18 shall not be permitted to register unless under the strict supervision of a legal guardian. Developers further reserves the right to require valid credit card information as proof of legal age. Developers maintains strict online Privacy Policy (§2.7) and will not sell or give your information to other parties.
3.2 User Account. In the event user accounts are permitted, Users will select a username and password upon completing the registration process. Users are fully responsible for maintaining the confidentiality of their username and password. User agrees to immediately notify Developers at lisa.calvocoressi@yale.edu should User know, or have reasonable grounds to suspect, that the username and password have been compromised. Developers shall not be responsible for User’s failure to abide by this section.
3.3 Indemnity. User agree to indemnify and hold Developers, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content or information you submit, post, transmit or make available through the web site, if any, your use of the web site, your connection to the web site, your violation of the TOUC, or your violation of any rights of another.
3.4 No resale. User agrees not to reproduce, copy, duplicate, or sell any portion of the Developers’ web site.
3.5 Limits and modifications. Developers may establish without notice limits on the use of its web site, including the maximum number of times Users may access downloadable content or materials or participate in the online communities, or to the number of times Users may access the Developers’ web site. Developers reserves the right to modify any and all portions of the Developers’ web site without notice. Under no circumstances shall Developers be liable to User or any other party for such limits or modifications.
3.6 Termination of User account. In the event user accounts are permitted, Developers may, at its sole discretion, terminate the User’s account for any reason. Under no circumstances shall the Developers be liable to User or any other party for such termination of User’s account.
3.7 Develops’ intellectual property rights. User agrees NOT to distribute, license, or create derivative works from any of Developers’ Copyright or Trademark, or Trade Dress, including written content or materials in whatever form or media, graphic files and software, available on the Developers’ web site.
3.8 General. This TOUC Agreement constitutes the entire agreement between you and Developers and governs your use of the Developers’ web site, and its downloadable content or materials. This TOUC Agreement shall be governed by the laws of the State of Connecticut. User agrees to submit to the personal and exclusive jurisdiction of the courts of Connecticut, including Federal Courts in the Connecticut Jurisdiction.
The failure to exercise or enforce any rights or provisions of this TOUC, on the part of the Developers, shall not constitute a waiver of such right or provision. If any provision of this TOUC Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOUC Agreement remain in full force and effect. Any claim arising under the terms of this TOUC Agreement must be brought within one (1) year after such claim or cause of action arose or be forever barred.
3.9 Violations. Please report any known or suspected violations of the Terms of Use and Conditions, including any suspected copyright or trademark violations, to lisa.calvocoressi@yale.edu.
